Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("you," "your," or "User") and Monetize-U AI ("Monetize-U," "we," "us," or "our") governing your access to and use of monetizeuai.com and all related products, services, automation tools, training, and content (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

You must be at least 18 years old and capable of forming a legally binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements and that the information you provide is accurate and complete.

Some features require you to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to:

• Provide accurate, current, and complete information during registration.
• Promptly update your information to keep it accurate.
• Notify us immediately of any unauthorized access or security breach.

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.

Certain Services are offered on a subscription or one-time purchase basis. By subscribing, you authorize us (and our payment processor, Stripe) to charge your designated payment method on a recurring basis until cancellation.

• Auto-renewal — subscriptions renew automatically at the end of each billing cycle unless cancelled before the renewal date.
• Cancellation — you may cancel anytime via your account settings or by contacting support. Cancellation takes effect at the end of the current billing period.
• Refunds — fees are generally non-refundable except where required by law or expressly stated. Digital products and completed services are final sale.
• Price changes — we may modify pricing with reasonable advance notice. Continued use after the change takes effect constitutes acceptance.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or internal business use, subject to these Terms. You agree NOT to:

• Copy, modify, distribute, sell, or sublicense any part of the Services.
• Reverse engineer, decompile, or extract source code from our software.
• Use the Services to send spam, conduct unsolicited outreach, or violate anti-spam laws.
• Engage in fraudulent, deceptive, or illegal activity.
• Upload malware, exploit vulnerabilities, or interfere with the Services.
• Scrape, crawl, or harvest data from our platform without written permission.
• Misrepresent your identity or impersonate another person or entity.

Our automation tools, AI chatbots, voice agents, and content generation features ("AI Services") produce outputs based on inputs and underlying models. You acknowledge that:

• AI outputs may be inaccurate, incomplete, or unsuitable for specific purposes — you are responsible for reviewing and validating them before use.
• AI outputs are not professional, legal, medical, or financial advice and should not be relied on as such.
• You are responsible for ensuring your use of AI Services complies with applicable laws, including consumer protection, communications, and consent requirements (e.g., TCPA, GDPR, CAN-SPAM).
• We may use aggregated, anonymized data from your usage to improve our models and Services.

You retain ownership of any content you submit, upload, or create using the Services ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, and display it solely as needed to provide and improve the Services. You represent that you own or have the necessary rights to your User Content and that it does not infringe any third party's rights.

The Services, including all software, content, designs, trademarks, logos, course materials, and proprietary tools, are owned by Monetize-U AI or its licensors and are protected by copyright, trademark, and other laws. Nothing in these Terms transfers any ownership rights to you. All rights not expressly granted are reserved.

The Services may integrate with or link to third-party tools, platforms, or websites (e.g., Stripe, Google, Meta, CRM providers). We are not responsible for the availability, content, or practices of third parties. Your use of those services is governed by their own terms and policies.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR PRODUCE ANY SPECIFIC INCOME OR BUSINESS RESULT. ANY EARNINGS OR INCOME EXAMPLES ARE AGGREGATE, ASPIRATIONAL, OR HYPOTHETICAL AND ARE NOT GUARANTEES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONETIZE-U AI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Monetize-U AI and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your User Content, your violation of these Terms, or your violation of any law or third-party right.

We may suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Services ceases immediately. Sections that by their nature should survive termination (e.g., intellectual property, disclaimers, limitations of liability, indemnification) will continue to apply.

These Terms are governed by and construed in accordance with the laws of the State of Nevada, USA, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration or the state and federal courts located in Clark County, Nevada, and you consent to their jurisdiction.

We may revise these Terms from time to time. The updated version will be posted with a new "Last Updated" date. Material changes will be communicated through the Services or by email. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
